Can a Police Officer throw a punch at your face, regarding the circumstances?
If you're intoxicated, and it's simply a known fact. And you have a hard time giving your hand to the officer to arrest you. Without throwing any punches or harming the officer in anyway, can the officer punch you in the face repeatedly?|||Police cannot use any more force than is necessary to perform their duties and/or defend themselves. If you TRULY were not actively resisting, punches would be illegal.|||Excessive force by police is nothing new - did you not see the video of Rodney King a few years ago - and the police got by with that crap. 10 officers using riot batons - over 50 strikes - just to handcuff one unarmed man. But to answer your question - if the officer believed that you were resisting arrest - he/she can use what force is reasonable and necessary to take you into custody.
